CALL TO ACTION TO STOP THE PROPOSED NEW EU CONSTITUTION
This is a campaign to raise the necessary funds in order to force a Declaration for a Judicial Review on the legitimacy of what the Government is intending to impose on the nation.
Fact - Britain's membership of the EU is Constitutionally Illegal. Contrary to common belief, Britain does have its own written constitution. Recent successive Governments have exceeded their Parliamentary powers that were laid down in ancient Statutory documents, such as the Magna Carta 1215, The Declaration of Rights 1688, and the Coronation Act 1688 – These are all still in force today.
As a result British membership to the EU is constitutionally illegal.
Our intent therefore is to challenge the Government's seemingly legal powers to surrender Britain's sovereignty and self-governance, by pressing for Judicial Review.
A powerful legal team has been assembled, led by Leolin Price CBE QC, to carry the case forward, but in order to launch proceedings; we inevitably need to raise funds.
Initially we planned to force on the Government an injunction but the grounds for an injunction seem no longer to apply and an application would, in Mr. Price's view almost certainly fail. So it is planned to seek a declaration for a Judicial Review. This we believe has a far greater chance of success in the light of the evidence available and the apparent changing attitudes within the ranks of the judiciary.
The original aim was to launch proceedings in advance of the Intergovernmental Conference (IGC) in July, however this is not essential and it may in fact be preferable to wait until the outcome of the IGC is known as it will give us more time to prepare and raise funds. It is essential however to get the case into the Courts before October 2007, when the new Treaty is scheduled to be signed.
John Gouriet (Chairman) Defenders of the Realm has said:
'Initially we need to raise £3000.00 to start with for a Barristers opinion. We have been assembling evidence in preparation for the legal assault for many months, however a tremendous amount of work still needs to be done before we go to court. In my view this can best be accomplished by our team which includes top class solicitors with the necessary hands-on experience of the case. Nevertheless it will still cost in the region of £200,000-£250,000.'
